How does mediation/conciliation work?
If the informal approach does not resolve the issues between the parties, consideration should be given to using a mediation process.
Mediation is a non-binding technique that establishes the mediator as the facilitator whose goal is to help the parties reach a mutually agreed solution. This may be achieved in a direct manner between the parties or separately through the mediator.
The process of mediation involves both parties agreeing to a set of ground rules including confidentiality. Following both parties explaining their positions, the mediator will assist them in identifying the key issues which need to be addressed and finding solutions to their problems.
